Disclaimer on Compliance
Our Services are designed to provide robust hosting solutions but are not intended to comply with regulations such as the U.S. Health Insurance Portability and Accountability Act (HIPAA). Please ensure our Services align with your requirements before use.

Termination Policy
At OSHOST, we provide flexible hosting plans for fixed durations, such as monthly or annual subscriptions. While we aim to ensure your satisfaction, you may terminate your services at any time per the terms of your plan. Please note that termination policies vary depending on the selected plan and any promotional offers applied.

Auto-Renewal Terms
To avoid interruptions in your hosting services, OSHOST enables automatic renewal of your plan unless explicitly stated otherwise. The auto-renewal feature ensures that your hosting plan is renewed seamlessly on your renewal date. Details about how to disable auto-renewal are available in your account dashboard.

Refund Policy
We strive to provide you with the best hosting experience, and your satisfaction is important to us. If you are dissatisfied with our Services, our refund policy will apply. Refund eligibility varies based on the terms of your hosting plan and the duration of usage.

User Responsibilities
As an OSHOST user, you are required to comply with all applicable laws and guidelines. You are responsible for ensuring that your hardware and software are compatible with our hosting solutions. Additionally, maintaining a secure account, backing up your content, and promptly addressing any malware issues are your responsibilities.

Billing and Payment
At OSHOST, we offer a variety of hosting plans and add-ons to meet diverse needs at competitive prices. All payments are collected in advance for the selected term of your plan, whether it’s a monthly, annual, or customized duration. Your account dashboard provides clear details of your billing cycle and payment history.

Resource Usage
Efficient resource utilization is critical to ensure optimal performance for all customers. OSHOST requires users to use server resources responsibly. Terms of Service


Agreement Overview
This Terms of Service agreement ("Agreement") is entered into between you ("User," "you," or "your") and OSHOST, unless explicitly stated otherwise. By using the services provided on our website or via other platforms (collectively, the "Services"), you agree to abide by the terms outlined in this Agreement.

Eligibility for Use
  1. Age Requirement: You must be at least 18 years old to register or use our Services. Any use or registration by individuals under this age is unauthorized.
  2. Authorization: If you are using the Services on behalf of another party, you represent that you have the authority to bind them to this Agreement.
Account Responsibilities
  • It is your responsibility to provide accurate and up-to-date information during registration. This includes a valid contact email address unrelated to the domain registered under the account.
  • Maintaining accurate information ensures uninterrupted access to the Services, especially for critical updates or security communications.
  • You are fully responsible for all actions performed under your account and must safeguard your login credentials. OSHOST will not be liable for any misuse due to compromised credentials.

Verification and Security
For certain services, including dedicated server purchases, OSHOST may require additional verification such as government-issued identification. Failure to provide requested verification may result in denial of service.

Service Limitations and Disclaimers
OSHOST  is committed to providing robust hosting solutions, including shared, VPS, and dedicated hosting. We strive to maintain reliable operations; however, we are not liable for disruptions caused by factors beyond our control. Full details of service inclusions and limitations are available for each hosting plan.

Modification of Terms
OSHOST reserves the right to update or modify this Agreement at any time. Users will be notified of significant changes to the Terms of Service. Continued use of our services signifies your acceptance of these changes.

Company Content
All materials available on OSHOST’s platform, including but not limited to designs, text, graphics, images, videos, software, and their arrangement, are proprietary property of OSHOST  or its licensors. These materials (referred to as "Company Content") are protected under applicable copyright and intellectual property laws. Users are prohibited from modifying, reproducing, distributing, framing, or exploiting Company Content for any purpose unless explicitly authorized by OSHOST. Attempting to reverse engineer, decompile, or derive source code from any Company Content is strictly forbidden. Unauthorized use will result in the termination of your rights to access OSHOST's services and content. Any rights not expressly granted within this agreement remain with OSHOST and its licensors.

User Content
Users can upload, store, display, and distribute their content, including text, photos, videos, and other materials, on OSHOST's platform ("User Content"). You retain ownership of your User Content, but by using OSHOST services, you grant the company a non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute your content solely to deliver OSHOST's services. This includes creating backup copies to ensure service continuity. Users are solely responsible for their content and for ensuring it complies with applicable laws and does not infringe third-party rights. OSHOST does not monitor User Content but reserves the right to remove any content violating this agreement or applicable laws without prior notice.

Compliance with Laws
As a user, you are responsible for adhering to all applicable laws, regulations, and local requirements regarding the use of OSHOST services. This includes ensuring compliance with data protection laws like GDPR if applicable. OSHOST acts as a data processor for personal data you may handle through its services, and you are the data controller. You are responsible for obtaining the necessary permissions for processing personal data and providing appropriate privacy disclosures to your end users.

Prohibited Use
OSHOST services are not designed to handle sensitive data, including medical or health information regulated under HIPAA. Users are explicitly prohibited from storing such information on OSHOST servers. Non-compliance with this clause may result in immediate termination of services.

Additional Responsibilities
Users are responsible for providing accurate details about their website features and services to end-users and ensuring compliance with applicable terms and privacy policies. Delays in meeting these responsibilities may impact OSHOST's ability to deliver services effectively.

404 Error Page
In the event you fail to configure a 404 error page, a default page will be provided by OSHOST. This default page may include advertisements, promotions, or other materials at OSHOST's discretion, including links to third-party websites or services. By not configuring your own 404 error page, you consent to the placement of OSHOST’s default 404 error page on your domain. OSHOST reserves the right to collect and retain any revenue generated from such content. You may customize or configure your 404 error page at any time.

Third-Party Products and Services



Third-Party Providers
OSHOST  may offer products and services from third-party providers. These offerings are subject to the third party’s terms and conditions. Promotions, discounts, and special offers may also carry restrictions determined by the provider. You are advised to review and confirm the terms of any purchase or use of goods/services directly with the third-party provider. OSHOST does not guarantee the quality, availability, or timeliness of third-party products or services and is not liable for any issues arising from transactions with these providers. All engagements with third-party providers are at your own risk. OSHOST is not an agent, representative, or fiduciary for you or any third-party provider in these transactions.

OSHOST  as a Reseller or Sublicensor
OSHOST may act as a reseller or sublicensor of certain third-party software, hardware, and services ("Resold Products"). OSHOST is not responsible for changes in services that render Resold Products obsolete or affect their functionality. All rights and remedies for such Resold Products are provided by the original manufacturer or service provider, and you agree to adhere to their terms. Resold Products must be used exclusively in conjunction with OSHOST’s services. Tampering, reverse engineering, resale, or export of Resold Products in violation of applicable laws is strictly prohibited.

Third-Party Websites and Content


OSHOST's services may include links to third-party websites ("Third-Party Sites") and content such as text, graphics, videos, or other materials ("Third-Party Content"). OSHOST does not monitor or verify the accuracy or appropriateness of Third-Party Sites or Content. Accessing such sites or content is at your own risk, and their terms and policies will govern your use. OSHOST  is not responsible for any losses or issues arising from your interaction with Third-Party Sites or Content.

Prohibited Persons and Usage
OSHOST’s services are subject to export control and economic sanctions under applicable laws, including those administered by the U.S. Department of Commerce and other authorities. You may not use OSHOST’s services to violate these laws.

By using OSHOST, you confirm that:
  • You are not located in or associated with countries or regions subject to economic sanctions, including Cuba, Iran, Syria, North Korea, and others as specified by law.
  • You are not listed as a Specially Designated National or otherwise restricted under applicable sanctions.
  • You are not engaged in prohibited nuclear, missile, chemical, or biological weapons-related activities.
OSHOST reserves the right to deny service or terminate accounts in violation of these provisions.

Account Security
You are responsible for maintaining the security of your OSHOST account, including using strong passwords and ensuring that all scripts or programs installed under your account are secure. Weak passwords may lead to account suspension until corrective action is taken. OSHOST may audit accounts periodically to ensure compliance and security. If your account is found to be compromised or involved in unauthorized activities, it may be disabled or terminated. OSHOST may assist in account clean-up for an additional fee if requested. Unauthorized access to third-party systems using your OSHOST account is prohibited and may result in suspension or legal action.

Compatibility with Services
You are responsible for ensuring that your website and content are compatible with OSHOST’s services, hardware, and software, which may be updated periodically. OSHOST is not responsible for any delays or issues caused by incompatibilities or your failure to meet service requirements. Backups of all content are your sole responsibility. OSHOST does not provide guarantees for content backup and shall not be liable for any data loss. We recommend maintaining regular backups of all critical data.

Monitoring and Migration
OSHOST systems, including all related equipment and networks, are for authorized use only. OSHOST may monitor its systems for security and operational purposes. Any unauthorized activity, such as connecting to third-party systems without authorization, is strictly prohibited. For compliance, technical, or operational reasons, OSHOST reserves the right to migrate your account to a different data centre without prior notice. Billing and Payment Information



Prepayment
You are responsible for keeping your payment information up to date and ensuring timely payment of all invoices. Payments for services must be made in advance of the period during which the services are provided. Payments may be applied to any outstanding invoices in your account at our discretion, subject to applicable laws and regulations.

Autorenewal
Unless explicitly cancelled, your services may automatically renew to prevent service disruption. Billing will be processed using the credit card or other payment details on file. If you wish to discontinue a service, you must notify us before the renewal date.

Advance Account
If you maintain a credit balance, it will be used to process purchases. Orders will not be processed if the balance is insufficient. Negative balances must be cleared within 24 hours, failing which services may be terminated immediately and without notice.

Taxes
Service fees do not include taxes unless otherwise stated. Any applicable taxes will be added to your invoice and must be paid by you. All payments are non-refundable unless explicitly stated.

Late Payment or Non-Payment
Outstanding invoices may result in service suspension or termination. Services will not be reactivated until the outstanding balance is cleared. Dedicated servers are subject to permanent data deletion if payments are not made within 15 days of expiry.

Domain Payments


Domain Registrations
Payments for domain registrations are non-refundable once the domain is registered.

Domain Renewals
Domain renewals can be managed in your control panel. Renewal notices are sent as a courtesy, but OSHOST is not liable for missed renewals or failure to notify about renewal deadlines.

Fraud
Any misuse or fraudulent use of payment methods is prohibited and may be reported to law enforcement or financial authorities. OSHOST reserves the right to take appropriate action in such cases.

Invoice Disputes
If you have any questions about the charges, contact our billing department for clarification.

Price Changes
OSHOST reserves the right to adjust service pricing or fees with a minimum of 30 days’ notice. It is your responsibility to review the billing information provided through our communication channels.

Coupons and Discounts
Promotional codes are valid only for new customers or first-time purchases and cannot be applied to renewals unless otherwise specified. Abuse of promotional offers may result in suspension or additional charges.

Refunds and Cancellations


Refund Policy
Refunds are available only for first-time accounts and apply to shared hosting services cancelled within 30 days. No refunds are issued for renewals, domain registrations, or additional services.

Non-Refundable Services
Certain services, such as dedicated servers, VPS hosting, SSL certificates, and software installations, are non-refundable. For further details, refer to the specific product terms.

Cancellation Process
You may cancel services through your control panel. Access to your account may be suspended upon cancellation, but prepaid services will remain active until the end of the billing cycle.

Termination of Services
OSHOST reserves the right to terminate services immediately under the following circumstances:
  • Non-payment of fees.
  • Violation of terms and conditions.
  • Actions deemed harmful to OSHOST or others.
  • Abusive behavior towards OSHOST staff. Upon termination, all data associated with the account, including files and websites, may be permanently deleted.

Usage Policies


CPU, Bandwidth, and Disk Usage
Hosting resources are intended solely for website-related purposes. Excessive resource usage or violation of the Acceptable Use Policy may result in account suspension or data removal.

Bandwidth
Shared hosting plans offer unmetered bandwidth, while other plans are subject to specific limits as outlined in the plan details.

Reseller Terms
Resellers are responsible for managing their clients and ensuring compliance with OSHOST policies. OSHOST does not provide direct support to reseller clients. Violations by reseller clients may result in account suspension. By using OSHOST services, you agree to the terms and conditions outlined above. OSHOST reserves the right to modify these terms at any time, with updates communicated via email or through the user dashboard.

Limitation of Liability
In no event will OSHOST, its directors, employees, or agents be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages, including but not limited to lost profits or lost data arising from your use of the services, user content, or any materials accessed or downloaded through our services, even if OSHOST has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, OSHOST’s liability to you or any party claiming through you for any cause whatsoever, regardless of the form of the action, is limited to the amount paid by you to OSHOST for the services in the three (3) months prior to the event giving rise to the liability. This limit is aggregate, meaning multiple claims will not increase the liability cap.

Indemnification
You agree to indemnify, defend, and hold harmless OSHOST, its affiliates, and their respective officers, directors, employees, and agents (each an “Indemnified Party”) from any claims, damages, losses, liabilities, suits, actions, or demands brought by a third party, including expenses such as reasonable attorney’s fees, arising from:
  1. Your use of the services.
  2. Any breach or violation of this Agreement.
  3. Any acts or omissions by you.
These terms of indemnification shall survive the termination of this Agreement.

Arbitration


For Users in India:
All disputes or controversies arising out of or relating to this Agreement (“Dispute”) shall be referred to and resolved by arbitration in Mumbai, India, under the Arbitration and Conciliation Act, 1996.
The arbitration shall be conducted by a single arbitrator mutually agreed upon by the parties. If the parties fail to agree, the arbitrator shall be appointed as per the Act's provisions. The language of the arbitration shall be English.

For Users Outside India:
Disputes will be resolved per the Company’s Arbitration Agreement, which is incorporated herein by reference.

Independent Contractor
OSHOST and its users are independent contractors. Nothing in this Agreement creates a partnership, joint venture, or principal-agent relationship. Neither party has the authority to bind the other in any way.

Governing Law
  • For Users in India: This Agreement shall be governed by the laws of the Republic of India.
  • For Users outside India: This Agreement shall be governed by the laws of the Commonwealth of Massachusetts.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

Backups and Data Loss
Your use of our services is at your sole risk. OSHOST does not maintain backups of your accounts or data. You are responsible for maintaining backups of all files and data stored on our servers. OSHOST will not be held responsible for data loss or file corruption.

Limited Disclaimer and Warranty
Our services are provided “as is” and “as available.”OSHOST, along with its affiliates, employees, and licensors, disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no guarantees:
  1. That the services will be uninterrupted, error-free, or completely secure.
  2. About the results obtained from using the services.
  3. Regarding the accuracy or reliability of the information provided.
OSHOST is not responsible for the content of data transferred or stored on its servers. These terms will survive the termination of this Agreement.

Changes to the Agreement or Services
OSHOST reserves the right to change or modify this Agreement at any time. We will notify users of significant changes by posting a notice on our website for at least thirty (30) days. The date of the last revision will be mentioned at the bottom of this document. Your continued use of our services after such changes constitutes your acceptance of the modified terms. If you do not agree with the changes, you must stop using our services.

Entire Agreement
This Agreement, along with all incorporated policies and documents, supersedes prior discussions, negotiations, and agreements, constituting the sole and entire agreement between OSHOST and the user.

Severability
Suppose a court of competent jurisdiction finds any provision or portion of this Agreement to be illegal, invalid, or unenforceable. In that case, the remaining provisions or portions (unless otherwise specified) shall remain in full force and effect.

Waiver
No failure or delay by you or OSHOST to exercise any right or remedy under this Agreement shall constitute a waiver thereof. Similarly, any partial exercise of a right or remedy shall not preclude further exercises of the same or any other right or remedy. A waiver of any breach or default shall not constitute a waiver of any subsequent breach or default.

Assignment and Successors
You may not assign or transfer this Agreement, or any rights or obligations hereunder, without the prior written consent of OSHOST. Any attempted assignment in violation of this Agreement is void. OSHOST may assign its rights and obligations under this Agreement and may engage subcontractors or agents to perform its duties without your consent. This Agreement shall be binding upon and benefit the parties, their successors, and permitted assigns.

Force Majeure
Neither party shall be liable for any delay or failure in performance due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, or supply chain disruptions. This does not excuse failure to make payments when due.

Third-Party Beneficiaries
Except where expressly stated, this Agreement does not create any rights for third parties. However, if a third-party product or service is specified as having third-party beneficiary rights in the service description, those third parties may enforce relevant terms of this Agreement.

WordPress Plugins
If you use WordPress plugins provided by Automattic through OSHOST (e.g., Jetpack), you agree to:
  1. The WordPress.com Terms of Service.
  2. The Automattic Privacy Policy includes data collection policies by Automattic.


Appendix A: Third-Party Products and Services
By purchasing third-party products or services from OSHOST, you agree to this Agreement and the respective terms and conditions of these providers. These are incorporated into this Agreement by reference:

General Provisions:
This Agreement represents the complete understanding between the parties regarding the use of OSHOST services. Any modifications to this Agreement must be in writing and signed by both parties.
